Face us politically,if You possess any courage.(Hurriyat to pupet regime)


APHC while condemning the house arrest of Syed Ali Geealni on 8th July and the continuous detention of other pro freedom leader ship has said that Omar Abdullah has miserably failed as a ruler and is just trying to consolidate his position and his rule through excessive use of force. Omar Abdullah does not possess the courage to face the pro freedom leadership politically and is using the state force as an escape route.

Terming the continuous detention of Muhammad Ashraf Sahrai, Ghulam Nabi Sumji, General Moosa, Aasiya Andrabi ,Raja Mehraj ud din, Mir Hafizullah and Muhammad Rafiq Ganai ,despite courts ordering their release, as political vengeance, APHC spokesperson said that the health condition of these leaders is worsening in captivity. He said that their continuous detention is a gross violation of not only human rights but of the state law as well.

Spokesperson APHC Ayaz Akbar said that Geelani was again put under house detention on the evening of 7th July when he returned from the releasing function of his autobiography “WULAR KINARAY”. Mr Geelani had to address the Friday congregation at TRC mosque in connection with the campaign of releasing political prisoners. But police crackdown not only affected this program but Mr. Geelani was not allowed to offer the Friday prayers as well.A bunker vehicle was parked in front of his residence with a huge contingent of police deployed.
Spokes person said that Mr. Geelani has been prevented from offering Friday prayers since June20 2010. In the past 382 days he has been allowed to offer this religious obligation only a few times.

Spokesperson said that it was a straight interference into the religious matters of a an individual which is not expected from a country that boosts to be ‘Secular’.
Spokesperson also expressed surprise on the conduct of the state police who hold a person literally ‘hostage’ without any order from court or administration. It is just like mafia kidnapping a person at the point of a gun and such action are nonacceptable in any part of the civilized world.

Commenting on the Continuous imprisonment of old and ailing leader Muhammad Ashraf Sahrai, Ghulam Nabi Sumji, General Moosa, Aasiya Andrabi ,Raja Mehraj ud din, Mir Hafizullah and Muhammad Rafiq Ganai ,despite court orders the spokesperson said that the government does not have any logical reason to keep these leaders in custody . Court has already passed orders for their immediate release and bail has been granted to them in all pending cases.
Spokesperson said that when all the formalities for the release of Mr Sahrai were completed police station Kupwara got judicial remand for him under a case of 2009 and he was sent back to jail.

In case of Ghulam Nabi Sumjhi when all the excuses to keep him imprisoned exhausted, he is being kept in police station Raj Bagh Heabus Carpus where he is severely ill.
Mr Sumjhi was already suffering from various ailment and his continuous imprisonement has only worsened his condition.

Commenting on the continuous arrest of Aasiya ANDRABI spokesperson said that the ruling elite in Delhi and Jammu and Kashmir have lost their conscience and they don’t even feel ashamed in imprisoning ailing women continuous detention of sister Asiya Andrabi has worsened her health to alarming condition, but the cruel rulers are not showing any mercy. Because of detention of her husband for the past so many years her children are forced to live as ‘orphans’. Paying homage to the courage and steadfastness the spokesperson said that our sister has made the nation proud through her sacrifices and proved that India despite all her force and credulity cannot make this nation to surrender before its might.

Spokes person appealed the Amnesty international and red cross to take cognizance of the severe conditions faced by the prisoners and make efforts to ensure their release.

New Delhi And State Govt. Prolonging The Detention Of Hurriyat leaders : Sayed Ali Shah Geelani


Insisting on the immediate release of detained Hurriyat leaders and works Syed Ali Geelani Chairman of Hurriyat conference said that, puppet regime is prolonging the detention of Hurriyat leaders with out any justification. This situation has made the whole valley like prison cell. The chairman of Hurriyat conference pays tributes to the martyred children and other people of the wullar tragedy on the eve of the fifth anivisory.He also felt sorry that the people who done this crime are not brought to justice till date. This is the reason that the parents of those diseased are living with sufferings. The chairman yesterdas went saidakadal srinagar where he shows sympathy to the old aged and ailing mother of Hurriyat leader Genral Mousa and pay the special blessings to his mother. In a press release the Hurriyat chairman said that the General Mousa has spent almost last twenty years in jail.During this period he suffered from various shocks.He was in jail when his father Moulana Sadiq sahib was martyred and he is also in prison till date when his old mother is near to death. The puppet regime is prolonging the detention of General Mousa..He also pays tribute to the General Mousa for his steadfastness. He also said that one of the brothers of Generaal Mousa has also got martyred in the freedom struggle of Kashmir. He himself has given immense Sacrifices during this struggle. He also suffered from numerous diseases in the detention center. By not providing the proper treatment in the jail he looks like premature aged person.The Hurriyat chairman said today no war charges is against the detained Hurriyat leader but has been detained by the puppet regime only because of draconian laws. The Hurriyat chairman also said that the general secretary of Hrriyat conference Mr. Ghulam Nabi Sumji is also detained from several years. On the other hand his daughter is suffering from deadly cancer. His health has also badly suffered and is at dangerous leavel.Instead of issuing releasing orders in favour of Mr. Sumji the puppet government has kept him imprisoned only because of taking revenge. The chairman said that another person namely manzoor ahammad khan is also detained for the last two and a half years. During this detained period his mother, wife died. Suffered from this major tragedy, still the puppet authorities did not released him so far. Instead of releasing him the puppet government is searching for the reasons to prolong his detention. The chairman also said about the Mukhtar ahammad kumar of wanihama hazratbal who has been detained this time at Udhampur jail on the other hand some days back his father Ghulam Mohammad kumar died.The deatined person was the only earning hand of the five sisters and old aged mother. His family is living in miserable conditions. Despite all these happenings the government is not releasing him so far. Due to this their family is starving. The Hurriyat chairman said that the issue of detainees is not only the political but also a human one, and all those, detained from Kashmir are political prisioners.and illegally detained without any crime. They are honorable citizens of the society. They have been kept imprisoned only just for their political ideology. And this is the serious violation of human rights. The chairman also said that the Government has chosen the path of rigidity towards the political prisoners and is not releasing those prisoners whose family members have died or suffered from deadly diseases during the detention period. Chairman of Hurriyat Conference said that even though the releas orders are issued from New Delhi, but the puppets here are so unconscious they do not bother to talk about the hot and burning issue. The Hurriyat chairman appealed to the Amnesty international and other groups that they should took the serious note of this issue and force the Indian Government to release all the detainees with no more delay.

Police stop Navlakha at Srinagar airport

Noted human rights activist and writer, Gautam Navlakha on Saturday was stopped at the Srinagar International Airport by the police from visiting the Valley.His presence not needed in Kashmir: Police

Navlakha, who arrived this afternoon in the summer capital, on a personal visit was barred from leaving the airport by the police citing law and order problem.

“Police officials handed over a formal order issued by the district magistrate. I have been deported back,” Navlakha Told.

The police officials served a written order issued by the district magistrate, Budgam to Navlakha to return to New Delhi or face detention for violating the prohibitory orders under section 144.

Lashing out at the state authorities he said, “This is outrageous. They are not willing to listen to reason. This shows the level of control they exercise on people.”

Navlakha said that he has been frequently visiting the Valley for over two decades now and this is the first time his entry was restricted. This was for the first time I had not come for work as I was planning to take trekking in Kashmir, he added.

He said police offered to drop him at Jammu in their vehicle. "I refused saying that I am not a criminal," he said.Several close friends, he said were also prevented from meeting him

Superintendent of Police, Security Airports, Abdul Hamid Bhat told that he was not aware of any such development at the airport.

“Honestly, I know nothing about this incident,” he said.

However, Superintendent of police (SP) Budgam, Uttam Chand said that Navlakha’s entry into Budgam district has been restricted following the orders from the civil administration.“We feel that his presence is not needed here,” Chand said.

Murtaza Manzoor was rearrested by police on the day of his release from prison

The Jammu and Kashmir authorities must immediately release or charge a teenage anti-government protester who was rearrested this week after spending three months in administrative detention, Amnesty International said.
Murtaza Manzoor, 17, was briefly released from prison on Wednesday after the High Court found that his administrative detention was unlawful. He was immediately rearrested by police.
Amnesty International said it is likely that a repeat administrative detention order for Murtaza Manzoor will be passed, allowing police to detain him without charge or trial for up to two years.
"The police in Jammu and Kashmir are playing a game with the judiciary. Courts order a person's release only for the police to wait outside prison to re-arrest them. This farce should stop," said Sam Zarifi, Amnesty International’s Asia-Pacific Director.
"Murtaza Manzoor must be released immediately, unless he is charged with a recognizable criminal offence. If so, he should be remanded in custody by an independent court and his rights as a child should be recognized. The authorities must not order his repeat administrative detention."
Although he is 17 years old Murtaza Manzoor is being treated as an adult because the laws of Jammu and Kashmir define boys above the age of 16 as adults. This contravenes both Indian law and the UN Convention on the Rights of the Child.
The Chief Minister of Jammu and Kashmir has said that the laws will be amended to make them consistent with international law and standards.

"We can clearly see the need to amend the law in Jammu and Kashmir because teenage boys are held in jails with no special facilities for juveniles," said Sam Zarifi.

Police arrested Murtaza Manzoor on 21 January in the state capital Srinagar. He was accused of attempted murder, assault and rioting, based on allegations that he led a June 2010 protest against the Indian government that turned violent and resulted in protesters rioting and pelting police with stones.
On 8 February, fearing that Manzoor would be released on bail, police placed him in administrative detention under the highly problematic Jammu and Kashmir Public Safety Act (PSA), which allows for up to two years’ detention without charge or trial.

On 13 May the High Court of Jammu and Kashmir found Murtaza Manzoor's detention to be unlawful and ordered his release.On 18 May, instead of being released to his father who was waiting outside the Kot Bhalwal Jail, Murtaza Manzoor was escorted from the prison by four policemen of a specialist counter-insurgency team and taken to the Joint Interrogation Centre at Jammu.

Police told his father that Murtaza Manzoor would be kept at the interrogation centre for a few days before being handed over to a police station in Srinagar. "Murtaza’s case illustrates the ‘revolving door’ nature of detentions widespread in PSA cases, as documented in Amnesty International’s recent report: A Lawless Law,” said Sam Zarifi. “ Murtaza Manzoor's family was not given any information on the alleged offences for which he is being held. Amnesty International said it believes his detention may be unlawful.

At least 322 people are reported to have been detained without trial under the provisions of the Public Safety Act in Jammu and Kashmir from January to September 2010 alone.A number of them, including children, have been detained on similar grounds of stone pelting and rioting during various protests against the Indian government throughout the summer of 2010.
